The Constitutional Court of Republika Srpska has confirmed the unconstitutionality of the Law on the Special Registry and Publicity of Non-Profit Organisations, known as the “foreign agents” law, months after the Constitutional Court of BiH struck it down. The law, adopted in 2025, had been widely criticised as a repressive measure targeting civil society, journalists, and government critics, and violating freedom of association and international human rights standards. The entity court halted its review after confirming the legislation had already been annulled by the state-level ruling and therefore no longer applies. The state constitutional court found the law inconsistent with constitutional protections and the European Convention on Human Rights, concluding that provisions labelling groups as “agents of foreign influence” and restricting vaguely defined political activity were not necessary in a democratic society.
